Requirements for establishing ten kinds of business environment in Jinan

Some measures to support the construction of real economy projects

To further implement the national, provincial and municipal requirements for deepening the reform of 'decentralization, integration of management, optimization of service', continue to establish ten kinds of business environment including the highest approval efficiency, the least approval items and the best government services, and serve the development of real economy, we develop following measures for construction of real economy projects on the industrial land and logistics storage land.

I. Guaranteeing the land for construction and development of projects

(1) The land use index is tilted to the real economy, and the large projects and good projects with great contributions to social economy and a high level of intensive land use shall be fully guaranteed according to law. (2) In accordance with the principle of 'land planning once but land supply by stages', real economy projects that have larger demand for land or are constructed by stages can be provided with land by stages and in batches. II. Reducing the cost of project land use

(1) For industrial projects with development priority and intensive land use, after being confirmed by county/district governments (including Jinan High-tech Zone Management Commission, Jinan Southern Mountain Area Management Commission, Jinan New-old Kinetic Energy Conversion Pilot District Management Commission (in the planning), Jinan International Medical Science Center Management Commission (in the planning) and the Park Management Commission authorized by the municipal government, the same below), the land can be transferred according to no less than 70% of minimum price limit for industrial land transfer as well as the cost of the land. For real economy projects with effective exploitation and utilization of underground space, the land price will be reduced by about 25%. (2) Under the precondition of compliance with the planning and no change in land use purpose, enterprises shall no longer be charged with land fees by making use of the existing industrial land to build factories and other production facilities. III. Implementing flexible management of project land use

According to their own needs, the real economy projects can use land in many ways such as a long-term lease, lease and then transfer, a combination of lease and transfer, and flexible transfer, and local county/district governments determine the way of land use and transfer deadline according to the actual situation. IV. Expediting the approval for project land use and planning

(1) Actively striving for and undertaking the approval authority for the provincial agricultural land transfer and land expropriation schemes. The relevant approval time limit shall be compressed to less than 30 working days. (Responsible unit: Municipal Land and Resources Bureau)

(2) For industrial and warehousing projects, prior approval and affirmatory approval shall be made. After the projects determine the only land use intention, the planning department should review the scheme and issue opinions on the planning. If construction units obtain land ownership and submit a design scheme and a written commitment to meeting the requirements of the planning, construction project planning permit shall be issued within 10 days. For projects with special requirements for standard plants and production process, only the overall layout, index, building interval and retreats shall be reviewed. In the area with certain conveniences, the planning department may entrust relevant administrative agencies to conduct a technical review of the planning scheme and make a decision on permission according to the review opinions. V. Building a green channel for project construction

(1) After obtaining the approval and planning opinions, real economy projects can enter public resources trading market for bidding. Private investment projects can decide the way of contracting for projects by themselves, and non state holding projects can invite tenders by themselves and present it to the authorities afterwards. (2) Implementing the start-up filing system. After real economy projects obtain the project approval and land transfer contract as well as the planning opinions, and organize the construction team in accordance with regulations., they start construction first, and the procedures should be perfected simultaneously. (3) Quality and safety supervision, and completion acceptance should be followed up in a timely manner to ensure that the project is put into operation at an early date. (Responsible unit: Municipal Urban and Rural Construction Commission)

VI. Strict management of project division and right determination

(1) Adapting to the development needs of the real economy and the changing situation of the capital market, and strengthening and refining the management of industrial land. It is strictly forbidden to engage in residential and commercial building development in the name of industrial land. For industrial projects, it is necessary to conduct in-depth investigation and research, seek truth from facts and carry out strict management if project division and right determination are indeed needed. (2) For a single industrial project, due to production needs, in the process of investment acceptance, joint investment, foreign investment and cooperation, there is a need for property right division without changing the purposes and in accordance with the planning. After being audited and approved by the county/district governments and the Municipal Economic and Information Technology Commission, and confirmed by relevant departments, a floor can be regarded as a smallest unit to make project division and right determination. (Responsible unit: Municipal Land and Resources Bureau; Cooperation unit: Municipal Development and Reform Commission, Municipal Economic and Information Technology Commission, Municipal Planning Bureau, Municipal Urban and Rural Construction Commission, Municipal Housing Security Administration, and county/district governments).

(3) For a single industrial project with no actual production or low utilization rate after completion, if there is a need for property right division without changing the purposes and in accordance with the planning. After being audited and approved by the county/district governments and the Municipal Economic and Information Technology Commission, and confirmed by relevant departments, the county government is allowed to transfer the industrial projects supported by the province and city according to the cost price assessed and approved by the third party entrusted by the government, and a floor can be regard as a smallest unit to make project division and right determination. (4) For a single industrial project that must be changed for commercial use on the premise of meeting the needs of urban planning, after approval by the county/district governments, purchase and reservation in the status quo are allowed. After re-planning, bidding, auction and listing in the current planning or after the division are implemented. (5) In order to support the rapid landing of small and medium-sized and micro enterprises, the governments of various counties and districts are encouraged to organize the construction of a comprehensive and professional park with modern standard plants. The construction of such parks should adhere to the government's leading role, encourage the participation of social forces, carry out unified planning and construction, and centrally integrate management. The industrial plants must be sold at a price limit and restricted from being sold externally, and they will be segmented and transferred according to the planning purpose with a floor as the smallest units. VII. Cleaning up the problems left over from history

(1) For the projects constructed on original D & R land (C6 land) before January 1, 2012, the single building constructed by the government and government platform in a joint way without change of use purposes can divide and determine right according to floor and room; if it has changed use purposes but in line with the planning, after making up for the land price difference and the related fees, project division and right determination can be made. The supervision of the existing land for industrial comprehensive use should be strengthened according to the relevant regulations of the existing post-approval management. (3) For the low-efficiency land for inefficient development by the enterprises, the unfinished part can be reclaimed after the consent of the planning department and land and resources department, and it is redesigned according to the existing planning. And bid, auction and listing are implemented for the whole or the parts. (4) For the Zombie projects and rotten projects for inefficient development by the enterprises, purchase and reservation in the status quo are allowed, and they should be redesigned according to the existing planning. And bidding, auction and listing are implemented for the whole or the parts. VIII. Supporting the continuous development of enterprises

(1) The violation of relevant laws and regulations by real economy enterprises in construction field should be investigated and treated more quickly. Flexible ways of law enforcement should be adopted, such as administrative supervision and exhortation, law enforcement hints, minor problem warning, an interview for outstanding problems, return visit for cases, to avoid just a stop or shut-up. The projects that are started in advance by industrial enterprises in accordance with the requirements of county/district governments and with records in the construction authorities in advance, are carried out according to relevant regulations. (2) The planning, design and construction of all kinds of parks, development zones, surrounding roads and municipal roads should be prioritized. And the public transport network should be increased or optimized and the transport capacity of public transportation should be enhanced. (3) Supporting the construction of public rental housing in various parks and qualified enterprises to solve the housing problems of these parks and the employees of the enterprises. IX. Strictly guarding against the damage of national interests

(1) After the division and right determination of real economy projects, business facilities (such as canteen, dormitory, small commercial facilities) should continue to be used according to the original matching functions. If transferred again in the premise of guaranteeing the original matching functions, confirmed by the planning department, the division and right determination can be made after making up for the land price difference and the related fees. (2) The change of the use purposes into a residence or apartment without authorization after the acquisition of land in the name of industrial or commercial office should be checked by urban management law enforcement and fire protection to home etc. Violations of laws for noncompliance with the standard of industrial and commercial office should be severely punished until completely corrected. (3) Strengthening the governance of projects after the completion, seriously investigating and dealing with the fraud, the unauthorized change of the planning conditions and the use of the land and buildings. (Responsible unit: Municipal Administration and Law Enforcement Bureau; Cooperation unit: Municipal Land and Resources Bureau, Municipal Planning Bureau, Municipal Urban and Rural Construction Commission, Municipal Civil Air Defense Office, and Municipal Public Security Fire Protection Brigade).

X. Effectively safeguarding the implementation of various policies

The municipal government sets up a special working group composed of the Municipal Development and Reform Commission, the Municipal Economic and Information Technology Commission, the Municipal Land and Resources Bureau, the Municipal Planning Bureau, the Municipal Urban and Rural Construction Commission, the Municipal Administration and Law Enforcement Bureau, and the Municipal Housing Security Management Bureau, which are responsible for the coordinated advance, supervision and management of construction of real economy projects. The responsible units should cooperate with the cooperation units within 1 month after the issuance of this notice, formulate specific implementation process and methods according to the above provisions, and strengthen the guidance services, supervision and inspection for the county/district governments. The county/district governments should earnestly strengthen the supervision and management of project construction.
